Διατροφή δικαιούνται να ζητήσουν ο σύζυγος, οι ανιόντες και κατιόντες (γονείς, τέκνα, παππούς, γιαγιά κτλ) και τα αδέλφια.

Επίσης, σύμφωνα με τις διατάξεις του Αστικού Κώδικα, καθιερώνεται η αμοιβαία υποχρέωση των συζύγων για κοινή συμβολή τους (με τα εισοδήματα, την περιουσία τους αλλά και την προσωπική τους εργασία) στις οικογενειακές ανάγκες (διατροφή δική τους, διατροφή των τέκνων τους κι υποχρέωση για συμβολή στις ανάγκες του οικογενειακού οίκου). Ο επιζών σύζυγος στερείται τη συνεισφορά του θανόντος συζύγου και δικαιούται αποζημίωση για την στέρηση αυτής της συνεισφοράς.

Τέλος, σύμφωνα με τις διατάξεις του Αστικού Κώδικα, οι γονείς, υπό κάποιες προϋποθέσεις, δύνανται να διεκδικήσουν από τα τέκνα παροχή υπηρεσιών. Με το θάνατο σε τροχαίο κάποιου από τα τέκνα τους, στερούνται αυτές τις υπηρεσίες και δικαιούνται αποζημίωσης για τη στέρηση των υπηρεσιών αυτών.

Χρηματική Ικανοποίηση λόγω Ψυχικής Οδύνης

Η στενή σύνδεση που έχουν διάφορα πρόσωπα με το θανόντα συνεπάγεται ιδιαίτερο ψυχικό πόνο λόγω του θανάτου του. Ο ψυχικός αυτός πόνος κατ’ αρχήν δεν είναι αποτιμητέος σε χρήμα. Ωστόσο, επιδικάζεται μια εύλογη αποζημίωση λόγω αυτού του ψυχικού πόνου. Η χρηματική ικανοποίηση λόγω ψυχικής οδύνης είναι συνήθως το πιο κομβικό κονδύλιο που περιλαμβάνεται στο αγωγικό δικόγραφο.

Δικαιούνται χρηματικής ικανοποίησης λόγω ψυχικής οδύνης οι στενά συνδεδεμένοι με το θανόντα. Στην πράξη, στενά συνδεδεμένα θεωρούνται τα μέλη της οικογένειας του θύματος. Η έννοια της οικογένειας, ωστόσο, δεν καθορίζεται από το νόμο, αλλά από τη νομολογία.
